controlled substance in truck while on duty

As I was driving in South Carolina, I was pulled over by dot for what he called failure to maintain lane. While pulled over and standing at rear of truck, officer went into truck and recovered 2 zanax tabs and 4 methadone tabs that were in unmarked prescription bottle. I was arrested for possession of controlled substance x 2.


I have been driving for approx 8 yrs with a spotless driving record. No felony arrests. I actually didn't intend on having the two drugs with me, I had forgotten i had them.



Well I spent 2 and a half days in jail and finally saw the judge whom posted me a 5000 bond. Now I go back to court in may to face the charges. Naturally I would like to avoid losing CDL, could this be possible under these circumstances and could this be considered an illegal search?

Any controlled narcotics in a unmarked bottle is a felony. And in a commercial vehicle is bad. If you don't loose your license you wont get a job now days with the 2010 cds laws. Some times you may have to wait 5 years and take drug classes. And for the illegal search failure to maintain a lane is probably cause for a search. Its not worth even to carry a beer now days. Good luck
