Retroactive isn't right

I really don't understand how they can go back and take into consideration your DOT stops and even if you just got a warning on something, hold it against you when it did not even count against you at time. There would have been no violation noted at the time, but now it will count against you with the new rules. Making up retroactive rules as you go is absurd. Are there any lawsuits against this part yet?
